1. Acceptance of Terms

Welcome to SkipTheChores! By accessing or using the SkipTheChores website (SkiptheChores.com) and its services (collectively, the “Services”), you (“User” or “you”) agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, please do not use the Services. These terms are governed by the laws of Canada, including the *Personal Information Protection and Electronic Documents Act (PIPEDA) and other applicable provincial privacy laws.

2. Description of Services

SkipTheChores provides an online platform that connects users with independent service providers (“Professionals”) for various household and personal tasks. SkipTheChores acts solely as a facilitator and is not responsible for the actions or omissions of Professionals.

3. User Accounts

  • To access certain features of the Services, you may be required to create an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You agree to provide accurate and complete information when creating your account.
  • You are responsible for all activities that occur under your account.
  • SkipTheChores reserves the right to suspend or terminate your account for any violation of these Terms.

4. Booking Services

  • You can book services through the SkipTheChores platform.
  • SkipTheChores will connect you with a Professional based on availability and your stated requirements.
  • The price for the service will be displayed before booking.
  • You are responsible for providing accurate details regarding the service request.
  • SkipTheChores is not responsible for any disputes between you and the Professional.

5. Payment and Fees

  • You agree to pay the fees for the services booked through SkipTheChores.
  • Payments are processed through our secure third-party payment processor.
  • SkipTheChores may charge a service fee in addition to the Professional’s fee.
  • Cancellation policies may apply, and you may be charged a cancellation fee if you cancel a booking within a specified timeframe.

6. Cancellation and Rescheduling

  • You may cancel or reschedule a booking subject to our cancellation policy.
  • Cancellation policies vary depending on the service and the Professional.
  • SkipTheChores reserves the right to cancel a booking due to unforeseen circumstances.

7. User Conduct

You agree to use the Services in a responsible and lawful manner. You will not:

  • Violate any applicable laws or regulations.
  • Infringe upon the rights of others.
  • Post or transmit any offensive, defamatory, or illegal content.
  • Interfere with the operation of the Services.
  • Attempt to gain unauthorized access to the Services.
  • Engage in any fraudulent or deceptive activity.
  • Harass, abuse, or threaten any other user or Professional.

8. Professionals

If you are a Professional using the SkipTheChores platform:

  • You are responsible for complying with all applicable laws and regulations.
  • You are responsible for providing quality services to Users.
  • You are an independent contractor and not an employee of SkipTheChores.
  • You are responsible for obtaining any necessary licenses or permits.
  • You agree to maintain adequate insurance coverage.

*   SkipTheChores is not responsible for your actions or omissions.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. SKIPTHECHORES DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT THE SERVICES WILL MEET YOUR REQUIREMENTS. SKIPTHECHORES DOES NOT WARRANT THE QUALITY, SUITABILITY, SAFETY, OR ABILITY OF PROFESSIONALS.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SKIPTHECHORES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OF OR INABILITY TO USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; (C) ANY CONTENT OBTAINED FROM THE SERVICES; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.  IN NO EVENT SHALL SKIPTHECHORES’S AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID TO SKIPTHECHORES IN THE SIX (6) MONTHS PRIOR TO THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless SkipTheChores, its officers, directors, employees, and agents from and against all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your use of the Services, your violation of these Terms, or your violation of any rights of another.

12. Intellectual Property

The SkipTheChores website and its content, including but not limited to text, graphics, logos, and software, are the property of SkipTheChores and are protected by copyright and other intellectual property laws. You may not use any SkipTheChores intellectual property without our prior written consent.

13. Data Privacy and Personal Information

SkipTheChores is committed to protecting your privacy. Our collection, use, and disclosure of personal information are governed by our Privacy Policy, which is incorporated by reference into these Terms. By using the Services, you consent to the collection, use, and disclosure of your personal information as described in the Privacy Policy and confirm that you have read and understood it. We comply with the *Personal Information Protection and Electronic Documents Act* (PIPEDA) and other applicable provincial privacy laws.

14. Modifications to Terms

SkipTheChores reserves the right to modify these Terms at any time. We will post any changes on the Site, and the updated Terms will be effective upon posting. Your continued use of the Services after the posting of revised Terms constitutes your acceptance of the revised Terms.

15. Termination

SkipTheChores may terminate your access to the Services at any time, with or without cause. You may terminate your account at any time by contacting us.

16. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Province of [Choose a Canadian Province, e.g., Ontario] and the federal laws of Canada applicable therein, without regard to its conflict of law principles. Any legal action or proceeding relating to these Terms shall be brought exclusively in the courts of Ontario.
